eBay Help. Seller “cannot locate CD.” Transaction Unilaterally Cancelled

    I hope someone on this forum can help me. And if this has happened to you, I apologize and can now empathize with you.

    Long story short, I purchased a rare CD from a seller. He contacted me Thursday (Thanksgiving) and said he cannot find the disc, and is going to refund me. I immediately responded that I would wait and I want the disc and not the refund. Today, he refunded me.

    Now here is where it gets interesting: He had auctioned this CD last month, same description, same pictures, same condition, etc. This auction received a lot of bids and “sold” for several hundred dollars.

    The eBay buyer, (as it would appear) never paid, or it was a shill account that “won.” Two bidders were in a bidding war. When he recently re-listed, I “won” the auction for a significant amount lower than the first auction. (It was still 3 figures.)

    He waited a couple of weeks (said he was traveling), and two tells me he cannot find this disc, and issues the refund when I specifically said I would wait and wanted the disc.

    He had 100% feedback, on several thousand transactions, and I have bought from him at some point in the past.

    What is my recourse here? I tried to contact eBay this evening; however, did not get to far. However, they did say I could open a case that will be reviewed by their team, which I will do.

    Thank you for reading this and thanks in advance for any advice. I waited a few before posting here; however, I am still very mad. This is fraud. Period.

    In my experience, eBay wants the simplest solution possible that doesn't require anything from them. You got your money back so let it go. You can't force him to send a CD he says he doesn't have.

    Maybe. Best of luck to him. I have zero faith in eBay's problem solving. They really don't care about the little guys anymore.

    I don't see the point of opening a case you won't win. It's pretty clear that the seller is within his rights to refund you, which he did. Claiming that you would rather wait for him to "find it" isn't really a winning argument.

    That is negative feedback worthy in my opinion. I've encountered the same thing you did a few times when bidding on vinyl and I "won" it for less than average market value.

    eBay will not do anything, I never even bothered calling them in these instances, they can't force the seller to send the item. Maybe if he has enough complaints like this they'd close his account. Maybe they would investigate the first instance if it was shill bidding, they do take that really seriously.

    For the time being (on eBay at least,) it has become my raison d'être.

    Truth.

    Agree with you. I will be leaving negative feedback for the first time on eBay.

    Also, this effectively ends my eBay purchasing of anything collectible. Once I am able to replenish my funds, I will stick to the Wanted To Buy section on this forum. I have had zero problems with transactions here.
