    Check out this auction:
    http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=2578045321&category=1056&rd=1

"mymusicfix2" cancelled this auction with 10 hours left. The highest bidder had bid $6. They cancelled the auction because of an "error in the listing". This is such BS! This is the second time in a week that I know they cancelled an auction early because of what they perceive as low bids. (Damn - they charge $15 shipping).

I know we have discussed them before for their very high prices - but this is a new low. ebay hall of shame for sure....

How do they get away with this? Exactly what "error in the listing"? I saw this happen with this set:

eBay auction for 5 Coltrane gold discs

    same thing with this one

    5 Miles Gold discs

They set these auctions with low opening bids and no reserve. Didn't like the bids I guess. The Coltrane was up to like $81 I believe. Not sure about the Miles. But now, that bidding history is wiped!

It will be interesting to see if these two go to completion:

8 Zeppelin Japanese Mini Lp cds

    16 Jazz gold discs

This seems highly unethical. They should've used a reserve...

I believe these are the same masters used in the Canadian releases of these as well. The Canadian mini-lp versions of these are available for $20 each at my neighborhood Newbury Comics.

The units shown in the auction aren't true Japanese issues- notice the lack of OBI's!!! I believe he refers to the the fact they are from Germany sort of.

This exact BS happened to one of our own where this seller canceled within 2 hours (IIRC) of the auctions ending. What a low-life.

I have spoken with the guy on the phone before. He seems OK. I think he kind of fell into the business by accident. He had some of these golds or had access and went from there. It's part of a larger business. I don't really think he's a "music guy" like us. It's business. I asked him about some longboxes and he was clueless. I had ordered a Hendrix box from the guy and he put the sealed Red Trumpet box inside his own shipping box and sent it to me. At the time I had never heard of Red Trumpet so he did me a favor and it was a twenty dollar lesson.

I don't justify the things he does and he prices his stuff to high. As far as the price thing goes it's buyer beware of course. That doesn't explain the other stuff but I bet is someone contacted him he would explain. Just a hunch

He has previously been setting very high reserves and BIN prices and the stuff has not been shifting. Now he has put some of his items up with low starting prices and no reserve - I think you're right that he is pulling the items if the bids aren't high enough for him. Having said that, I just won a sealed DCC Venus And Mars from him for $52.05 when his usual BIN price is $99.

Just a correction here....the seller canceled at the very closing second of the auction and Ebay will do absolutely nothing for the buyer.

Is this a case of the Piranha protecting the Shark and is it even legal? Sounds like Ebay no longer will do anything for the buyer even when in the right. :(

I don't care for the way this guy does business.

A few years ago I ordered a mint CTA gold Mastersound CD from his website for $70, which I thought was a cheap (but reasonable) price - at the time they were going for about $100-$150 on Ebay. I ordered over the phone, which I always do with items that may be "out of stock" (he had only one copy). The clerk assured me that the item was in stock and the deal was done. I mailed a check that day.

A few days later I received my check back in the mail, along with a note of apology - the item was "out of stock" after all! As I knew he also sold on Ebay, I started watching his auctions, out of suspicion. Sure enough, less than two weeks later, he was selling the very same item on Ebay. I wrote him an email, politely asking him to fill my order, as he had apparently "replenished" his stock. He refused, adding "I sell to whoever (sic) I want" - which I interpreted as, "If I want to back out of a deal, even if it's just to get a few extra bucks, I will."

I get the impression that if the buyer did this to him, he'd be screaming. He must think he's being really clever, gaming the system with his auction cancellations...but how would he like it if the high bidder retracted his bid at the last minute, because he found it cheaper elsewhere?

    Hi,

Sounds like this turkey is worthy of repeated discussions so that all of our new members realize what he does! ;)

IMO, Ebay has a nice rating system that helps their users better understand who they are dealing with. It would be nice if Ebay also scored how many times a seller pulled an auction like Kayaker is describing so we are all aware of the chumps who play that game!

    Happy holidaze,
    Jeffrey :)

Yeah, I don't think he has an unlimited amount of DCC/MOFI's, he just never gets too many people to buy them!

We all know about his astronomical prices. You'll find another of his tricks when you visit his website -- many of his item descriptions say, "last copy."

Oh hey, is this the guy who has all those CBS Mastersound LPs on his website for outrageous prices, and lists them as "last copy" when stock is low? Horribly inflated prices. I ditched all of my Mastersounds on Ebay and they all sold for under $15.

I don't know if Ebay would do anything about it, but if you tracked this guy and kept a history of all his auctions for a month, and made note of which auction numbers were cancelled before the end...THEN told Ebay about it, it would show a history of this abuse. In a way it's a fee avoidance tactic.

Scumbag. Thanks for the warning, guys. :)

Ebay keeps track of bidders' bid retractions, part of their user feedback. I also think they should keep track of cancelled bids under a seller's ID.

BTW, I just dug a little on Ebay, and this seller is committing an Ebay seller offense of "Fee avoidance". To wit, look at the last item in this list--by cancelling early, he's avoiding having to pay the additional fee for setting a reserve price:

    http://pages.ebay.com/help/community/investigates.html

If this seller had cancelled on me, I'd immediately be e-mailing with the threat of turning him in for fee avoidance. Granted he'd make up an excuse, but still, that's what he's apparently doing. Then, you run the risk of negative feedback. I actually have had a second, unused ID that I could use for something like this. ;)

I don't think you can retract a bid in the last 24 hours of an auction. There is some time period before the end of an auction where you cannot retract a bid. Whatever it is, I know that you cannot retract a bid in the final minute.

This is a great thread. I've stayed away from this seller because of his exhorbitant prices. Now that I know that he is shady, I certainly won't buy from him. I hope he is reading this thread. :)

Looks like there will be no more early cancellations...his latest auctions have a reserve price - which I'm sure is sky high (it's probably within 15% of his "buy it now" price).

i was bidding on an everly brothers gold cd earlier this month and he pulled the auction on me too. i emailed him the following question:

what is your reserve for the everly brothers gold cd? why did you cancel the bids on the auction?

    and this was his response:

Bidders must realize that sellers cannot give product away below our wholesale and E-bay costs. When bidders have no idea of the items value then we most cancel the auction as bidders have the right to cancel their bids before the auction ends. It was E-Bay suggestion for music sellers to use this 01 concept to have bidders look at your products and this has been a new experience for us using this process. It has been successful in a few items but with others it has not been successful. We regularly sell both of these titles for $29.99 and within the year 2004 they will increase to close to $50 each because of there rarity. Sorry it didn't work out but simply the E-bay community were not bidding close to its value. We will be re listing this product but not at the 01 starting price but at 24.99 and Buy It Now at $29.99.

i'm reporting him to ebay for fee avoidance...

Good for you! :righton: This guy has been on Ebay, with his over-inflated prices for years. I don't believe for 1 second that this seller paid anywhere near what he tries to lead people to believe as he is a licensed retailer, which means he bought at wholesale prices.

$50.00! Uh, yeah right. This one typically gets between $15.00 and $25.00 for a sealed copy and has never had the demand that this seller believes.

I get the feeling some of these sellers think they can drive up the market price by just offering the goods at high prices. If they find a few suckers, they can say, "Well, I sold this last year for $50, and it's rarer now, so it's worth $75 this year."

Yep, best thing to do is file complaints against the seller for fee avoidance. He's nickel and diming it to death...can't even pay the reserve fee. I'm also willing to bet that with his new auctions, he'll close them early also if he gets no bids on them. Another fee avoidance tactic. (See the second to last item in the list I posted.)

This is just a profiteering opportunist trying to scrape out every last dime from his items. I'm all for a person making a good honest buck, but this is shady at best.

I do have a bidder blocked from my auctions as well ("vain99"--there are very few bids on this seller's existing items currently). I am willing to bet this seller we're discussing has another user ID, buying up cheaper items on Ebay and then reselling them....another possible reason why he appears to be so anal about getting high dollar. The seller I blocked was a known opportunist reseller who would buy up certain CDs at ANY price in order to corner the market and get all the titles out of circulation that he could, then would relist them at half.com, Amazon or Ebay at grossly inflated prices. I'll have the last laugh when the titles he's hoarding become essentially worthless when the record company reissues the albums in the future. ;) Nobody (other than us, who sometimes prefer earlier releases) in the general market is going to pay his $80 for a CD when it would be available from Best Buy for $11.99.
