I hope someone on this forum can help me. And if this has happened to you, I apologize and can now empathize with you. Long story short, I purchased a rare CD from a seller. He contacted me Thursday (Thanksgiving) and said he cannot find the disc, and is going to refund me. I immediately responded that I would wait and I want the disc and not the refund. Today, he refunded me. Now here is where it gets interesting: He had auctioned this CD last month, same description, same pictures, same condition, etc. This auction received a lot of bids and “sold” for several hundred dollars. The eBay buyer, (as it would appear) never paid, or it was a shill account that “won.” Two bidders were in a bidding war. When he recently re-listed, I “won” the auction for a significant amount lower than the first auction. (It was still 3 figures.) He waited a couple of weeks (said he was traveling), and two tells me he cannot find this disc, and issues the refund when I specifically said I would wait and wanted the disc. He had 100% feedback, on several thousand transactions, and I have bought from him at some point in the past. What is my recourse here? I tried to contact eBay this evening; however, did not get to far. However, they did say I could open a case that will be reviewed by their team, which I will do.
