how long to wait for payment?

I put up an item and it sold for $37.00, last Monday the 19th. I've emailed him three times and still no word, no payment. Strange because the guy has over 500 feedback. How long do I give him before I can offer it up to 2nd place? I can't seem to find this on the eBay help section it's so big. Thanks.

 

30 days I believe is "law". Some go for 7 or 15 but they must list that in the item...

 

Not be disagreeable or anything ,but I've always understood it to be 10 business days or 2 weeks.
